Terms of Service
This page is maintained by Food Explorer Club to explain the rules of using our app. It is not independent legal advice.
Agreement to these terms
By creating an account, accessing, or using Food Explorer Club (the "App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.
We may update these terms from time to time. We will notify you of material changes by email or through the App. Continued use after changes means you accept the updated terms.
Parent-managed accounts
Food Explorer Club is designed for families with children aged 3–12. A parent or legal guardian must create and manage the account. Child profiles are created and controlled by the parent account holder.
By creating an account, you represent that you are the parent or legal guardian of any child profiles added, and that you have the authority to consent to these terms on behalf of your children.
We do not knowingly allow children under 13 to create independent accounts or provide personal data without verifiable parental consent.
Subscriptions & billing
We offer a Free plan and a Family plan (paid subscription). The Free plan includes one child profile, no certificates, and limited food access. The Family plan unlocks unlimited children, all certificates, premium reels, full food access, and parent insights.
Subscription fees are billed in advance through our payment processor, Stripe. All prices are shown in your local currency where available and include applicable taxes unless stated otherwise.
You can cancel your subscription at any time. If you cancel, you will continue to have full access until the end of your current billing period. After that, your account will revert to the Free plan.
We do not offer refunds for partial billing periods, except where required by law.
What you can do
We grant you a personal, non-exclusive, non-transferable licence to use the App for your family's own use, subject to these terms. You agree not to:
- Use the App for any illegal or unauthorised purpose.
- Attempt to gain unauthorised access to any part of the App or its systems.
- Copy, modify, distribute, sell, or lease any part of the App without our permission.
- Use automated systems or software to extract data from the App ("scraping").
- Upload harmful code, viruses, or malicious content.
- Harass, abuse, or harm other users.
Content & intellectual property
All content in the App — including text, images, badges, graphics, videos, and software — is owned by Food Explorer Club or our licensors and is protected by copyright and other intellectual property laws.
You retain ownership of any photos or content you upload (such as child profile pictures). By uploading content, you grant us a limited licence to use, store, and display it solely for the purpose of providing the App to you.
You may not use our trademarks, logos, or branding without our prior written consent.
Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your family's data. By using the App, you agree to the Privacy Policy as well.
Disclaimers
Food Explorer Club is provided "as is" and "as available." We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.
The App is intended as a fun, educational tool to encourage food exploration. It is not medical advice, nutrition counselling, or a substitute for professional healthcare. If you have concerns about your child's eating, health, or nutrition, please consult a qualified professional.
We do not guarantee specific outcomes (such as a child trying new foods). Every child is different, and results will vary.
Limitation of liability
To the maximum extent permitted by law, Food Explorer Club and its owner, Melanie Douglas, will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
Our total liability for any claim arising out of these terms or your use of the App will not exceed the amount you paid us in the 12 months preceding the claim, or AUD $50 if you have not paid anything.
Nothing in these terms limits liability that cannot be excluded under Australian consumer law or other applicable law.
Termination
You may delete your account at any time from within the App or by contacting us. Upon deletion, we will remove or anonymise your personal data within a reasonable period, as described in our Privacy Policy.
We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if we need to do so to comply with legal obligations. We will try to notify you beforehand where possible.
Governing law
These terms are governed by the laws of Queensland, Australia. Any disputes arising from these terms or your use of the App will be subject to the exclusive jurisdiction of the courts of Queensland.
Changes to these terms
We may update these terms as the App evolves or as laws change. If we make material changes, we will notify you by email or through the App. The updated terms will always be available at this page.
